By creating an account you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance

By registering for or using GeoTechLive you confirm you are at least 13 years old (or the minimum age required in your jurisdiction), have the legal capacity to enter into this agreement, and if you are under 18, have obtained verifiable consent from a parent or legal guardian. The Company reserves the right to restrict or terminate access for any user who does not meet eligibility requirements.

2. The Service

GeoTechLive is an immersive digital and real-world interactive platform that integrates location-based technology with physical-world exploration, missions, competitions, and experiences. The Service will require physical movement, navigation to real-world locations, and interaction with environments that are not owned, controlled, or monitored by the Company.

3. User Accounts

You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the confidentiality of login credentials
Accept full responsibility for all activities under your account

You are solely responsible for any unauthorized access or use of your account.

4. Real-World Activity & Safety (High-Risk Disclosure)

A. Acknowledgment of Real-World Risk

YOU EXPRESSLY ACKNOWLEDGE THAT THE SERVICE INVOLVES REAL-WORLD MOVEMENT AND POTENTIAL EXPOSURE TO DANGEROUS CONDITIONS.

These risks include, but are not limited to:

Traffic hazards (vehicles, bicycles, pedestrians)
Unsafe terrain (water, cliffs, construction zones)
Criminal activity or third-party interactions
Weather and environmental conditions

The Apportunist LLC does not and cannot control real-world conditions.

B. Mandatory User Conduct Requirements

You agree that you will, at all times:

Comply with all local, state, and federal laws
Obey all traffic laws and signals
NEVER trespass or enter private/restricted property without explicit permission
Maintain full situational awareness at all times
NOT use the Service while driving, cycling, or operating machinery
Immediately stop use if conditions become unsafe

C. Express Assumption of Risk

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO SERIOUS BODILY INJURY OR DEATH, PROPERTY DAMAGE, EMOTIONAL DISTRESS, AND ENCOUNTERS WITH OTHER INDIVIDUALS.

5. Waiver, Release & Covenant Not to Sue

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, AND DISCHARGE Apportunist LLC, its owners, officers, employees, contractors, affiliates, and partners FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION — INCLUDING BUT NOT LIMITED TO NEGLIGENCE (INCLUDING ACTIVE OR PASSIVE NEGLIGENCE), PERSONAL INJURY OR DEATH, PROPERTY DAMAGE, AND THIRD-PARTY ACTIONS.

You further agree NOT TO SUE or bring any legal action against the Company arising out of or related to use of the Service, participation in missions, travel to/from locations, or real-world interactions.

6. Indemnification

You agree to fully defend, indemnify, and hold harmless Apportunist LLC, its parent companies, owners, subsidiaries, affiliates, partners, sponsors, licensors, service providers, vendors, contractors, agents, officers, directors, employees, successors, and assigns (collectively, the "Protected Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:

Your access to, use of, or misuse of the Service
Your participation in any missions, events, or real-world activities
Your violation of these Terms or any applicable laws or regulations
Your violation of any rights of a third party
Any injury, harm, death, or property damage caused by you or resulting from your actions or omissions
Any content you submit, upload, or transmit through the Service

The Company reserves the right to assume exclusive defense and control of any matter subject to indemnification (at your expense). You will not settle any claim without the prior written consent of the Company if such settlement imposes any liability on any Protected Party.

7. Acceptable Use

You agree not to:

Post content that is illegal, harmful, threatening, abusive, or infringing
Use the service to harass, threaten, or harm others
Attempt to reverse-engineer, hack, or disrupt the platform
Use automated scripts or bots to interact with the service
Violate any law or regulation
Engage in unsafe, reckless, or dangerous behavior
Cheat, exploit, or manipulate gameplay systems

8. Location-Based Services Disclaimer

The Service relies on GPS, mapping, and third-party data. You acknowledge that location data may be inaccurate, delayed, or incorrect; missions may direct you to unsafe or inappropriate areas; and you are solely responsible for verifying safety, legality, and accessibility.

9. Events, Missions, & Rewards

All rewards, prizes, and incentives are subject to availability and specific rules
The Company reserves the right to modify, suspend, or cancel missions at any time
The Company is not responsible for lost, stolen, delayed, or unclaimed rewards
Additional terms may apply to specific events

10. Intellectual Property

All content, trademarks, technology, and materials associated with GeoTechLive are the exclusive property of Apportunist LLC. You may NOT copy, reproduce, or distribute content; reverse engineer or exploit the software; or use branding without written permission.

11. User Content

You retain ownership of content you post. By posting, you grant GeoTechLive a non-exclusive, worldwide licence to display and distribute that content within the service. You are responsible for ensuring your content does not violate third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time, without notice, for violation of these Terms, unsafe or illegal conduct, or misuse of the platform.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPORTUNIST LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES; OR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE. IN NO EVENT SHALL TOTAL LIABILITY EXCEED $100 USD OR THE AMOUNT YOU PAID (WHICHEVER IS GREATER).

15. Dispute Resolution & Arbitration

All disputes shall be resolved exclusively through binding arbitration, except where prohibited by law. Venue: State of Wisconsin, United States. You waive any right to a jury trial and waive participation in class actions or class arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.

17. Force Majeure

We are not liable for failure or delay due to causes beyond our reasonable control, including natural disasters, government actions, network failures, or acts of terrorism or civil unrest.

18. Privacy

Your use of the Service is also governed by our Privacy Policy.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.

20. App Store Compliance

You acknowledge that these Terms are between you and Apportunist LLC, not Apple or Google. Apple Inc. and Google LLC are not responsible for the Service and have no obligation to provide support.

22. Severability
